#new Former Metro Police officer Michael Fanone was criminally referred to the DOJ on seven counts over January 6th, for allegedly lying to Congress and other charges, and is being sued for $10 million for defamation.
The criminal referral against Fanone was submitted by Ivan Raiklin to acting Attorney General Todd Blanche and DC Attorney General Jeanine Pirro. The document cites:
🔷️False statements to Congress,
🔷️Obstruction of official proceedings on Capitol grounds,
🔷️Assaulting and impeding certain officers and employees, and
🔷️Unlawful activities on Capitol grounds.
The DOJ has not confirmed that any formal charges have been filed yet, or that an active prosecution has started.
The referral is tied to Fanone’s conduct during a January House Judiciary Committee hearing on former Special Counsel Jack Smith’s testimony, Fanone’s January 6, 2021 actions and later statements.
Raiklin said he also filed a separate $10 million civil defamation lawsuit against Fanone that includes counts for defamation, assault, and threats.

🔺️“had been beaten unconscious and remained so for more than four minutes.”
🔺️He added that doctors told him he suffered a heart attack and later diagnosed him with a concussion, traumatic brain injury, and PTSD.
🔺️However, Bodycam footage from that day shows that Fanone was conscious and talking almost immediately after being pulled from the crowd.
🔺️EMT body cam footage shows emergency responders didn’t find any serious injuries, and Fanone was heard saying he was fine, then started joking with a colleague about the protesters.
🔺️Critics say Fanone’s overly emotional congressional testimony, and alleged exaggeration were constructed to fuel his media appearances, and book deals.
The point out the discrepancies between his sworn statements on injuries and consciousness versus bodycam evidence.
The referral represents an attempt to force authorities to investigate his statements under the same legal standards applied to others.
