An illegal migrant who was previously charged with first-degree rape and indecent liberties with a child has been arrested again for child rape after being freed from jail on bond, according to a report.

According to booking records, In January of 2020, 39-year-old Martin Malacara Guerrero was charged three counts of first-degree rape and four counts of indecent liberties with a child. Guerrero was booked into the Guilford County Jail on $200,000 bond and an ICE hold.
However, because the Guilford County Sheriff announced that the county is a ‘sanctuary’ county and will not honor requests from ICE to hold illegal migrants,
The Sheriff’s Office does not, however, honor requests (i.e., detainers) from ICE to actually hold an inmate for up to 48 hours after the inmate’s State criminal charges have been resolved. The reason is that the act of holding such inmates after their State criminal charges have been resolved is very likely a “seizure” for the purposes of the Fourth Amendment.
Guerrero was set free and allegedly raped a child.
