Biden Legalized Capture Of Maduro By Denying Him Head Of State Immunity, Raised Bounty To $25M


Actions taken by the Biden administration —including hiking the bounty on Maduro’s head to $25 million, branding him a fugitive, and stripping away any claim to head-of-state immunity—directly enabled the U.S. military’s operation – making it legal to arrest him on Venezuelan soil.

But as Maduro now faces justice in a New York courtroom on narco-terrorism charges, Democrats are condemning the very arrest they helped authorize as “illegal” and “unprovoked”

Here are the Details: 

In the final weeks of his presidency, Biden increased the bounty from $15 million set by the Trump administration in 2020 to $25 million. 

 

This move, announced by the State Department, was said to be made because of Maduro’s deepening involvement in narco-terrorism and his regime’s fraudulent 2024 presidential election.  

 

Opposition leader Edmundo González was widely recognized as the true winner by the U.S. and over 50 allies. 

 

Maduro was explicitly labeled a “fugitive from justice” in official U.S. communications, building on a 2020 Justice Department indictment accusing him of leading the “Cartel of the Suns” 

 

Since 2019, the U.S. has refused to recognize Maduro as Venezuela’s legitimate president, a policy initiated under Trump but maintained and reinforced by Biden.

This non-recognition effectively nullified any head-of-state immunity Maduro might claim under international law, treating him instead as a de facto criminal overlord . 

 

Legal experts say this stance cleared the way to arrest him in Venezuela. 

 

By early 2025, as Maduro’s regime cracked down on post-election protests—resulting in over 2,000 arrests and dozens of deaths—the Biden administration doubled down, recognizing González as the rightful leader-in-exile. 

 

Maduro was not viewed as a protected head of state but as a wanted drug kingpin evading justice. 

 

The combination of the bounty, fugitive status, and immunity denial created a framework where U.S. forces could lawfully pursue Maduro in Venezuela without violating sovereignty norms. 

Democrats, however, are now calling the arrest they enabled as an “illegal” overreach.

Rep. Jim Himes (the top Democrat on the House Intelligence Committee), has blasted the operation as “clearly illegal under international law,” arguing it lacked United Nations backing or congressional authorization. 

 

Rep. Rashida Tlaib called it an “unprovoked bombing and kidnapping,” while others, like Rep. Eric Swalwell, said it was “illegally going to war with Venezuela.”
